Em hipótese alguma a Logan revelará os dados pessoais coletados a terceiros sem a expressa autorização dos titulares dos dados ou sem que haja uma determinação judicial para isso. 2 – ABOUT US
Logan is the leading provider of real-world location information.
Its technology used verifies the presence of mobile consumers at millions of locations, points of interest and local events, providing unprecedented insight into consumer activities and interests.
Logan provides its Customers with Location Based Data Services and analytics services based on inferred interests and matching of Location Data (defined below) with location and event data. Customers rely on these Data Services to power advertising and marketing campaigns on mobile devices, to better understand their customers, gain competitive information, conduct law enforcement activities and improve national security, as well as provide and improve the services they offer to their customers.
3 – DESCRIPTION OF SERVICES
Logan provides a Data Service through a core of proprietary technology (using proprietary algorithms), native mobile, through SDK technology and collects and processes various types of information from mobile devices it receives from third-party partners. These third-party partners are owners of mobile application (“App”) or data aggregators that primarily receive data from software development kits (“SDK”) in Apps (SDKs allow developers to incorporate certain third-party functionality into their software applications).
Logan cleans, processes and merges the Location Data it receives from all sources to create a portfolio of Location Data records for each Mobile Ad ID.
In addition, Logan can receive from its third-party partners other information about the user’s device, such as IP address and device user agent data (as defined below).
4 – PURPOSE OF PROCESSING AND LEGAL BASIS
We reiterate that Logan does NOT process particular personal data, criminal data, or common data, as it uses anonymous, anonymized, aggregated, encrypted and pseudonymized data.
The transfer is made for the following purposes:
(i) Create aggregated analytics reports.
(ii) Develop demographic prediction models;
(iii) Develop location behavioral models;
(iv) Process the data to derive custom audience segments;
(v) Provide insights into consumer behavior for Licensee’s clients;
To provide Data services to its customers, however, it uses the data it receives from its partners.
They are the Partners who directly receive the consent of data subjects through their Apps.
We rely on App providers and our third-party data providers to obtain consent from the user. We contractually require our third-party data providers to comply with all applicable laws and only provide us with data that they have the right to transfer to us for our specific uses.
The legal basis for the processing is the fulfilment of legal and contractual obligations, and, also, the pursuit of the legitimate interest of the data controller ex Art. 6 GDPR: execution of orders imposed by the Authorities or other administrative body – Art. 6.1 lett. e), also to maintain the security of our services (for example to detect fraud or ensure that bugs are detected and resolved, to protect our system and information from unauthorized persons and to comply with the law); pursuit of the legitimate interest of the Data Controller in order to protect its rights and reasons of the same, also before the courts, provided that the interests or fundamental rights and freedoms of the data subject requiring the protection of personal data do not prevail – Art. 6.1 lett. f).
In determining legitimate interest, we consider and balance any potential impact on the rights of data subjects and to ensure that Logan’s interests do not override those of data subjects.
In some cases, we will process your Personal Data to comply with a legal or regulatory obligation in the EEA, UK or Switzerland (“Compliance with the law”).
However, we will only process Data for the purpose of the correct and complete performance of the Data Services.
5 – DATA CATEGORY
Logan uses aggregated, anonymized, pseudonymized and encrypted data, through SDK and Advertising ID, which it receives from its Partners.
The Personal Data transferred concern the following categories of data:
Hashed Device ID (IDFA or Android Advertising ID), Timestamp, Latitude, Longitude, Horizontal Accuracy (if present), Location Context (if present), IP Address (if present).
Each mobile advertising ID allows Logan to identify each unique mobile device and is used by advertisers and marketers to display ads on the user’s device.
Logan generally uses the following forms of data:
5.1. Cookie Privacy on Services
For marketing activities and advertising campaigns we only use cookies and pixels for which the users’ prior consent is not required.
In particular, when a user clicks on an ad (e.g., on the banner of one of our Client’s campaigns) a cookie is placed on his device to identify the ‘campaign’ in progress. The user is redirected to a website, where he/she can perform ‘an action’ i.e., a Conversion or Lead (e.g., filling in a contact form). So, when you get to the “Thank You Page”, our pixel (which is allocated there) retrieves the information stored in the cookie – only to identify the campaign – and counts the conversion or lead.
Therefore, our cookie is only used to associate the “lead” with a “specific campaign/product” and count it.
For the provision of data services to its customers, Logan uses and collects data it receives from its Partners:
Location Data: Precise geolocation data, including latitude-longitude coordinates obtained from Apps through requests to the mobile device’s operating system that uses various mechanisms to derive Location Data, including GPS tools, cell tower triangulation, Wi-Fi data or other techniques. Logan does not collect a user’s precise geolocation in real time. Neither Logan nor its third-party partners determine whether Location Data is received from GPS signals, cell tower triangulation, Wi-Fi data, or other techniques. The device operating system determines which signal is most readily available to the device and returns the Location Data to the corresponding app provider
Identifiers: IP address; Mobile Advertiser ID (“MAID”)
Internet or network activity: Timestamp, list of applications from which location signals were received.
Device user agent data: Device type; browser family; browser version; operating system version; device model number.
Demographic data: Age, gender, generation suffix, marital status, parental status, number of children, education level, annual income.

Research and analysis. To better understand how users access and use our website and for other research and analysis purposes.
Protection of rights and interests. To protect the safety, rights, property, or security of Logan, our services, any third parties or partners, or the general public; to detect, prevent, or otherwise address fraud, security, or technical issues; to prevent or stop activities that Logan, in its sole discretion, may deem to be, or risk being, illegal, unethical, or legally actionable; to use as evidence in litigation; to conduct audits; and to enforce this Policy.
Legal Compliance. To comply with applicable legal or regulatory obligations, including in legal proceedings; to respond to a subpoena, warrant, court order, or other legal process; or as part of an investigation or request, formal or informal, by law enforcement or governmental authority.
Logan uses the information it receives from its Partners to provide Data Services to its Customers. We do not use information collected through our Web Site to provide our Data Services.
Using the information, we receive from our Partners, we create a portfolio of user device Location Data records associated with the mobile advertising identification number. We also create virtual boundaries called “geofences” around places of interest, such as shopping centers, restaurants and events. We take the Location Data from your device and combine it with these geofences, as well as the other information mentioned above, to determine the places and events you have participated and to infer your preferences. As part of our Data Services, we also:
– Track key performance indicators throughout the duration of an ad campaign and determine whether a MAID served an ad visited a particular shop or location.
– Create insights and trends on consumer behavior, including foot traffic in and around a particular location, and predict future behavior.
– Create competitive consumer information for our customers, such as to identify new customers who may be interested in their offers, to identify and improve our customers’ marketing and advertising capabilities.
We do not use the information we collect to determine employment eligibility, credit eligibility, insurance eligibility, underwriting or pricing.
5.5 – How we share your information
We may share your information as follows:
– Affiliates: We may disclose your information to our affiliates or subsidiaries; however, if we do so, their use and disclosure of your information will be subject to this Policy.
– Service Providers: We may disclose the information we collect to third party vendors, service providers and contractors or agents who perform functions on our behalf.
– Customers: When we provide our Data Services, we share your information with our Clients, including your device location information, mobile advertising identifier, locations and events you have attended, interest segments, and device information. Our Clients may use this information for purposes such as analytics and advertising attribution services, marketing and personalized advertising, market research, including consumer research, business intelligence, such as consumer information, foot traffic and analytics, providing fraud detection analytics and services, analyzing movement information, providing security services, federal law enforcement and national security and public health. In some circumstances, our Clients may also resell your information to other third parties for similar purposes.
– Aggregated and De-identified Information. We may share aggregated and de-identified information with third parties for marketing, advertising, research or similar purposes.
– Asset Transfers. If we are acquired by or merged with another company, if substantially all of our assets are transferred to another company, or as part of a bankruptcy proceeding, we may transfer the information we have collected from you to the other company.
– To protect us and others. We may share your information if we believe it is necessary to investigate, prevent or take action regarding illegal activities, suspected fraud, potential threats to the safety of any person, violations of this Policy or as evidence in litigation in which Logan is involved.
– In response to legal proceedings. We may also disclose information collected if we believe such action is necessary to comply with the law, a court proceeding, court order or other legal process, such as in response to a court order or subpoena.
– With your consent. We may disclose information collected from you with your consent
5.6 Compliance with the law, response to requests from public authorities, prevention and protection of our rights.
Logan may disclose your data, including personal data, to courts, public authorities, government authorities or authorized third parties if and to the extent that it is required or permitted to do so by law or where such disclosure is reasonably necessary: (i) to comply with legal duties; (ii) to comply with legal process and to respond to claims made against Logan; (iii) to comply with requests relating to a criminal investigation or alleged or suspected illegal activity or any other activity likely to expose Logan to any risk whatsoever; (iv) to protect the rights, property or personal safety of Logan, its employees, its Members or the general public.
6 – POSSIBLE TRANSFER OF PERSONAL DATA
The management and storage of data takes place on a database of the Logan Company and/or of third-party companies appointed as Data Processors. The database on which the data is stored is located in the USA.
It is in any case understood that the Holders/Controllers have the right to move the location of the archives and servers to Italy and/or the European Union and/or countries outside the EU. The Holders/Contractors guarantee as of now that the transfer of data outside the EU is conducted in compliance with the applicable legal provisions, stipulating, if necessary, agreements that guarantee an adequate level of protection and/or adopting the standard contractual clauses envisaged by the European Commission.
Logan reserves the right to disclose your information if we are required to do so by law, or if we are requested to do so by authorities or law enforcement agencies (e.g., police, public prosecutor’s office).
Where there are relationships with third parties, Logan has ensured that we enter into contracts of assignment in accordance with Article 28 Paragraph 3 GDPR, Paragraph 7 GDPR, or the transmission of data takes place on the basis of a decision of the European Commission in accordance with Article 45 GDPR.

7 – EXISTENCE OF AUTOMATED DECISION-MAKING PROCESSES, INCLUDING PROFILING
The Logan Company does not adopt automated or semi-automated decision-making processes.
8 – YOUR RIGHTS
You have the right to ask us at any time for information about your personal data stored by us and their origin, the recipients or categories of recipients to whom these data are forwarded or made accessible, the purposes of storage and processing, the intended storage period, the decisions taken by us automatically, the right to data portability, the existence of the right to rectification, erasure (“right to be forgotten”), restriction of processing or withdrawal of processing and the right to lodge a complaint with a supervisory authority.
You also have the right to request that your personal data be erased and no longer processed if it is no longer necessary for the purposes for which it was collected or otherwise processed, if you have withdrawn your consent or objected to the processing of your personal data, or if the processing of your personal data is otherwise not in accordance with the Regulation.
All requests for information, access, withdrawals of consent, oppositions and any other type of request relating to the processing of data may also be sent by e-mail to privacy@logan.ai or to the address given in the introduction.
You have the right to lodge complaints about data processing activities with the data protection authorities.
Privacy choices
Opting out of data services If you wish to opt-out of the use of your Device Location Data and other related data that we use in our Data Services, you may either (a) deactivate the location services on your mobile device, or (b) complete the Opt-Out & Do Not Sell form. Note that opting out will be specific to the device for which you are submitting your opt-out request. This means that if you use multiple devices, you will need to opt-out for each device you use. Also, if you set your device’s advertising ID again, you will need to opt-out again for that device.
9 – DATA SECURITY
Technical and organizational security measures must be taken by the data controller that are appropriate to the risks, such as against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access, presented by the processing. Any person acting under the authority of the data controller, including a processor, must not process the data except on instructions from the data controller.
We take appropriate technical and organizational measures to ensure data security, in particular to protect your personal data and prevent it from being disclosed to third parties, accidentally or premeditated, lost or destroyed.
These measures are regularly reviewed and updated to the latest state of the art.
We design every function with the security of your data in mind. Our open-source SDKs use full SSL encryption for all communications. All device data receives one-way hashes with the MD5 hashing algorithm, the best for space and speed. Your application will never be rejected or flagged when transporting the SDK: Logan’s open-source technology exceeds the security and privacy controls of all major app stores.
Because your trust is important to us, we are committed to complying with the regulations and self-regulatory principles applicable to our data practices. We ask our publishers and other partners to adhere to the same standards we apply to our own practices and to provide appropriate levels of notice and choice.
We believe that your data is valuable. That is why Logan pursues only the strictest and most rigorous certifications in data storage and security.
Logan also offers its customers the option of opting out of the collection of persistent identifiers for certain end-users. If a customer notifies us that an end-user is under 13 years of age, has opted out of the service, or has waived the collection of personal information, Logan will not collect such information and will proceed to delete all information in its possession relating to that user as of such notification.
10 – RETENTION PERIOD
The Importer undertakes to take appropriate measures to ensure that the Personal Data transferred will not be retained longer than what is necessary to achieve the purposes for which it was transferred and no longer than the maximum retention period provided by applicable law.
We retain your Personal Information for as long as is necessary to comply with our legal and contractual obligations, enforce our agreements and allow us to investigate events and resolve disputes. We retain Location Data, Internet or Network Activity, and Device User Agent Data associated with a particular Mobile Advertising ID and used for our Data Services for up to 24 months, provided that such personal information may be retained for a longer period to the extent necessary for a significant legal or operational purpose, such as for compliance, record keeping, auditing, security, and error or bug prevention.
